Matterport Policy for Promotion of Third Party Vendor Offerings (Apps, Merchandise, Services)
As the Matterport ecosystem grows, we’ve created set of requirements for promotion of third-party offerings, which are designed to promote security, privacy and quality service for our greater community. These requirements apply to all products and services featured on the Matterport third party apps page, and supplement the Matterport Terms of Use, which are incorporated herein by reference.
1. General Guidelines for Matterport Third Party Offerings (Apps, Merchandise, and Services) 1.1 Your offering should provide a unique and interesting way for Matterport users to get the most out of their Matterport Spaces and expand their Matterport businesses. 1.2 Follow our Matterport Marketing Guidelines for your app/merchandise/service name, icons, and description. 1.3 Do not confuse, deceive, defraud, mislead, spam or surprise anyone. 1.4 Keep your app/merchandise/services negative feedback to a threshold. We will contact you regarding any negative feedback brought to our attention so that you may promptly address or rectify said issue(s). 1.5 Ensure that any content featured in your app/merchandise/product (including user-generated content) meets our Community Rules. 1.6 Vendors promoted on the third party offerings page must be in good standing with Matterport. 2. Provide Users with Data Security, Privacy and Control 2.1 If your app/merchandise/service features Matterport Spaces created by others, please obtain consent before publishing or otherwise using content on their behalf. 2.2 Provide, and comply with, a publicly available and easily accessible privacy policy that explains what data you are collecting and how you will use that data. Make sure your privacy policy is reasonably compliant with applicable laws and regulations. Provide a reasonably accessible link to your privacy policy in any marketplace where your app/merchandise/service is offered. 2.3 In jurisdictions that require informed consent for the storing and accessing of cookies or other information on an end user’s device (such as the European Union), ensure, in a verifiable manner, that an end user provides the necessary consent before you store and access cookies or other information on the end user’s device. 2.4 Obtain consent from people before you give us information that you independently collected from them. 2.5 If you are tracking a person's activity, provide an opt-out from that tracking. 2.6 Provide meaningful customer support for your product, and make it easy for people to contact you if they have questions or need support. 2.7 Protect the information you receive from customers or Matterport against unauthorized access, use, or disclosure. 2.8 If your application caches data you receive from us on the user’s device, use it to improve your app’s user experience and keep it up to date. 2.9 Caching data you receive from us on external servers (controlled by you or by third parties) is not permitted. 2.10 Do not collect Matterport usernames or passwords. 2.11 Don’t use Matterport user IDs as your mode of log-in. 2.12 Unless you have a separate agreement with Matterport to do so, don’t sell, license, or purchase any data obtained from us or our services. 2.13 Don't transfer any data that you receive from us (including anonymous, aggregate, or derived data) to any ad network, data broker or other advertising or monetization-related service. 2.14 If you are acquired by, or merge with a third party, you can continue to use our data only within your app. 3. Encourage Proper Use 3.1 Provide a product or service that offers something with unique value to the community. Don’t replicate or reskin core functionality that Matterport already provides. 3.2 Focus on user experience quality over clutter or pushing features that don’t work well. We’ve aimed to create a sleek and clean experience, and you should do the same. 3.3 Maintain performance. Ensure your service or product does not affect the load time of Matterport Spaces. 3.4 Consider the platforms you’re deploying to, and make sure the experience is good across supported platforms. 3.5 Don’t block the user’s view of pre-existing UI elements or add new ones that replace the existing ones.< 3.6 Respect the limits we've placed on Matterport functionality. 3.7 Don’t build a product whose primary purpose is to redirect people away from Matterport’s product or offering. 3.8 If you want to use our trademarks, logos or brand, you must follow the guidelines in the Matterport Marketing Guidelines. 3.9 Do not force overlaid banner ads on Showcase or force interstitial or video preroll ads. Contextually appropriate ads within Multimedia Mattertag Posts are acceptable. 3.10 Be honest about your relationship with Matterport when talking to the press or users. Get approval from us before issuing any press release, blog post or other public statement mentioning Matterport. 4. Follow the Law 4.1 You are responsible for restricting access to your content in accordance with all applicable laws and regulations, including geo-filtering or age-gating access where required. 4.2 You are responsible for complying with all applicable data privacy laws and regulations governing your collection, use and disclosure of personal information, including any applicable laws and regulations of the European Union. 4.3 Don’t redistribute, display or promote content that infringes upon the rights of any third party. 4.4 Ensure that you own or secure all rights necessary to display, distribute and deliver all content in your app. 4.5 Satisfy all licensing, reporting and payout obligations to third parties in connection with your app. 4.6 If your app contains content submitted or provided by third parties: a. In the United States, you must take all steps required to fall within the applicable safe harbors of the Digital Millennium Copyright Act including designating an agent to receive notices of claimed infringement, instituting a repeat infringer termination policy and implementing a notice and takedown process. In other countries, you must comply with local copyright laws and implement an appropriate notice and takedown process for when you receive a notice of claimed infringement. 4.7 Comply with all applicable laws and regulations in the jurisdiction where your app is available. Do not expose Matterport or people who use Matterport to harm or legal liability as determined by us in our sole discretion. 4.8 You agree to indemnify and hold Matterport harmless from and against all liability, judgments, damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to any claim or action against Matterport related to your service, actions, content or information. 5. We Reserve the Right… 5.1 We may share your contact info you designate with people who want to contact you. 5.2 We may use your name, logos, content, and information, including screenshots and video captures of your app, to demonstrate or feature your use of Matterport, worldwide and royalty-free. 5.3 If applicable, and upon our reasonable request, you will provide to us a complementary account in your app, solely to evaluate what an end user will see. We agree not to abuse this. 5.4 Matterport reserves the right to develop or create apps or products that offer features and services similar to your product. 5.5 Subject to your prior written consent, which you will not withhold or delay unreasonably, we can issue a press release describing our relationship with you. 5.6 We may take enforcement actions against your app or website as provided below if we conclude that your app violates our policies or terms or is negatively impacting our platform. We may or may not notify you in advance. 5.7 Enforcement is both automated and manual, and can include restricting the ability of your app or service to access to our data or platform functionality, requiring that you delete data, terminating our agreements with you or any other action that we deem appropriate. 5.8 We communicate with vendors through email from the Matterport.com domain. Ensure that the email address associated with your Matterport account and your email address registered with Matterport are current, and that you don’t filter out these messages. 5.9 We may change this policy at any time without prior notice. Please check it regularly. Your continued use of our platform, services or content constitutes acceptance of those changes. 5.10 Matterport reserves the right to remove any vendor from being promoted on the third party offerings directory at anytime. Things You Should Know About Your Apps: 1. Additional Policies for Optimized and Featured Apps 1.1 Your app must not be deemed as competitive to Matterport’s core offering. 1.2 Ensure your call-to-action links to the same app that generated the content. 2. Your app may be free, or for purchase. 2.1 You are solely responsible for all support, transactions, ecommerce, etc. relating to your app. 2.2 Regardless of pricing, your app must always be directly available for stand-alone purchase off your website or through a third-party app store. It may not be offered solely as part of a bundle, subscription, or similar. Definitions By "Matterport" or "Matterport Services" we mean the features and services we make available, including through (a) our website at www.Matterport.com and any other Matterport branded or co-branded websites (including sub-domains, international versions, widgets, and mobile versions); and (b) the Matterport Cloud.
